Military Spouse Residency Relief Act The Military Spouse Residency Relief Act was signed into law on November 11, 2009. This act amends the Service Members Civil Relief Act of 2003. The changes allows both the Military member and the spouse to retain his/her state of residency. Example: Tom enlisted in the Air Force in his home state of Minnesota in 2007 but is currently stationed in California. Under the Service Members Civil Relief Act of 2003 he would continue to file his returns in Minnesota not California. In 2009 he married Julie in Minnesota. She lives with him in California and is employed. Under this new law Julie will also be able to file her returns in Minnesota and not be responsible for filing or paying taxes in California. |
